Please read these Terms carefully before using our Services. If you do not agree to these Terms, you may not access or use the Services. These Terms constitute a legally binding agreement between you and Nexus Functions Creator.
By accessing or using the Services, you affirm that you are at least 18 years of age or have the legal capacity to enter into these Terms. If you are using the Services on behalf of a company or other entity, you represent that you have the authority to bind such entity to these Terms.
Nexus Functions Creator is a Shopify application that enables merchants to create custom checkout functions for discounts, shipping rules, payment validations, and other checkout customizations without requiring coding knowledge.
Key Features: Our Services include visual function builders, script migration tools, pre-built templates, and various function types for checkout customization. Specific features available depend on your selected subscription plan.
To use our Services, you must have an active Shopify store account. Our Services integrate with Shopify's platform and are subject to Shopify's own Terms of Service.
You are responsible for maintaining the confidentiality of your Shopify account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

Paid plans include a 7-day free trial period. You may cancel at any time during the trial period without charge. If you do not cancel before the trial ends, your selected plan will automatically convert to a paid subscription.
All payments are processed through Shopify's billing system. By subscribing to a paid plan, you authorize Shopify to charge your payment method on a recurring monthly basis.
We reserve the right to modify our subscription fees at any time. Price changes will be communicated at least 30 days in advance and will not affect your current subscription period.
Refunds are provided only for the Enterprise plan under its 30-day money-back guarantee. Other plans are non-refundable except as required by applicable law.
You may use our Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services:

The Services and their original content, features, and functionality are owned by Nexus Functions Creator and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You retain ownership of any functions, rules, and configurations you create using our Services. By using our Services, you grant us a worldwide, non-exclusive, royalty-free license to use, host, and display your content solely for the purpose of providing the Services to you.
Any feedback, comments, or suggestions you provide regarding the Services may be used by us without any obligation to you.
Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, and disclose information about you. By using the Services, you consent to our collection and use of information as outlined in the Privacy Policy.
Our Services integrate with and rely on Shopify's platform. Your use of Shopify is governed by Shopify's own terms and policies. We are not responsible for Shopify's services or any issues arising from Shopify's platform.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, secure, or error-free, or that any defects will be corrected.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL NEXUS FUNCTIONS CREATOR, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US FOR THE SERVICES DURING THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.
You agree to defend, indemnify, and hold harmless Nexus Functions Creator and its affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.
You may stop using our Services at any time by uninstalling the App from your Shopify store. Paid subscriptions will continue until the end of the billing period.
We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
Upon termination, your right to use the Services will immediately cease. We will delete your data within 30 days of termination, except as required to comply with legal obligations.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the Services or by email. Your continued use of the Services after such modifications constitutes your acceptance of the modified Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Wilmington, Delaware.
These Terms constitute the entire agreement between you and Nexus Functions Creator regarding the Services and supersede all prior agreements and understandings.
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
